Hearing Date Aug. 26, 2013

On December 12, 2012 there was a status conference where the lawyers representing Anthony Apanovitch and the prosecutor talked with the judge to set the discovery deadlines and the date for the hearing on the DNA evidence that proves Anthony's innocence. The judge figures it shouldn't take more than three days and he set the hearing dates for June 26, 27, and 28. So some time in June Anthony will be taken back to Cleveland Ohio for the hearing.

Tony Apanovitch : A Second Look

On 11/9/11 I talked with my attorneys about filing Petition of Certiorari with the United States Supreme Court. That will be done very soon. The issues of the state withholding evidence from my trial lawyers should be enough to get me a new trial, and if it doesn't, the I am fortunate to have the DNA evidence that the state hid for ten years. I can file my actual innocence petition and hopefully get a new trial from the state court. State court judges are not afraid to grant new trials with DNA evidence plainly showing the need for one. It is not like before DNA when they are concerned about being swayed by evidence that wasn't precise like DNA, and maybe getting it wrong. My case is easy for the judge, the DNA evidence clearly shows that I am not the man that raped and murdered that poor woman. So giving me a new trial is not a chance he has to take, it is the right thing to do.
